Land of Pillows Terms of Service ("Agreement")

Welcome to Land of Pillows (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your use of our website, located at landofpillows.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. Please read them carefully before proceeding.
1. Intellectual Property
All content, including but not limited to the Site’s design, text, images, graphics, and functionality, is the property of The Canton Group Inc and protected by intellectual property laws, including copyright and trademark laws. Unauthorized use, including copying or reproducing images, titles, or descriptions without written consent, is prohibited and subject to legal action. Repeat offenders will not be warned before action is taken.
2. Termination of Access
We reserve the right to terminate your access to the Site without notice or liability, for any reason. All provisions of these Terms which by their nature should survive termination shall continue in full force and effect, including but not limited to intellectual property ownership, warranty disclaimers, indemnity, and limitations of liability.
3. Third-Party Links and Payment
The Site may contain links to third-party websites or services that are not owned or controlled by Land of Pillows. We assume no responsibility for any third-party content, policies, or practices. We encourage you to review the terms and privacy policies of any third-party sites you visit.
Purchases made through third-party payment services (e.g., Amazon Pay, Google Pay, PayPal) are subject to those services’ terms. Any breach of data within these third-party systems is the responsibility of the service provider, not Land of Pillows. Our return and exchange policy takes precedence over any third-party policies. Unauthorized chargebacks or returns may be subject to a restocking fee and additional charges.
4. Governing Law
This Agreement, along with any disputes arising from it, shall be governed by and construed under the laws of the state of Florida, USA, without regard to its conflict of law provisions.
5. Fit Recommendations
We provide size recommendations based on our own pillow covers and inserts. If you use products from other manufacturers, we cannot guarantee a proper fit. As these items are handmade, slight variations (up to ½ inch) in size may occur due to fabric characteristics or construction variances. These deviations are considered normal and are not grounds for a return or exchange.
6. Communications and Recordings
All communications, including emails and phone calls, may be recorded for quality control and training purposes. By contacting us, you consent to this practice. We recommend adding landofpillows.com to your email safe list to ensure order notifications are received. Unsubscribing from our marketing emails will not affect transactional communications related to your orders.
7. Chargebacks & Disputes
Chargebacks or disputes initiated without first contacting us may result in a $30 processing fee per chargeback. Unauthorized returns, including those without an approved Return Merchandise Authorization (RMA), are considered final sales and will not be accepted. Customers who file chargebacks will be prohibited from making future purchases on our site.
We reserve the right to pursue compensation for any fraudulent chargebacks, including original item costs, shipping fees, bank fees, and legal fees.
8. Color and Pattern Variations
Due to natural variations in textile manufacturing, minor differences in color (known as dye lot variations) are normal and not considered defects. Variations in color can also occur due to screen settings and lighting conditions when viewing product images online. We do not guarantee exact color matches and recommend ordering fabric samples when color is critical.
9. Product Returns
As all our items are custom-made, we do not accept returns or exchanges unless the item arrives defective or incorrect. If you receive a defective or incorrect item, you must contact us within five (5) business days to initiate a return or exchange. Unauthorized returns will not be accepted. All items must be returned in their original packaging, in new condition, free of pet hair, odors, dirt, and allergens.

10. Delivery Issues
We are not responsible for items once they leave our possession. Any items returned as undeliverable or due to an incorrect address will require the customer to pay additional shipping charges. Failure to pay for re-ship charges will result in FINAL SALE with NO REFUND GIVEN. For items lost or damaged in transit, please contact the carrier directly. If you purchased additional insurance, we can assist in filing a claim on your behalf.
11. Damaged Goods
In the event that an item is damaged during transit, it is the customer’s responsibility to retain all packaging materials and file a claim directly with the carrier. Failure to provide adequate proof of damage may result in the claim being denied.
Land of Pillows is not liable for items that are lost, damaged, or marked as “delivered” by the carrier but not received by the customer.
All damage or defect claims not caused by the shipping carrier must be reported to Land of Pillows within 5 business days of delivery. Any claims submitted after this period will be considered as customer-damaged and will not be eligible for warranty coverage.
12. Warranty Limitations
Due to the nature of handmade goods, slight variations in size and color may occur. These are not considered defects. Any warranty claims must be accompanied by photo evidence when requested. Failure to provide such evidence may void any warranties.
13. EU Customers
We do not accept returns from European customers due to the custom nature of our goods. Any taxes, duties, or fees (such as VAT) are the customer’s responsibility. For information on shipping times and customs delays, please refer to our Shipping Policy.
14. Giveaways & Promotions
Giveaways and promotions, such as those hosted on social media, are governed by the specific terms outlined in the promotion. A random name generator will be used to select winners. Void where prohibited. No purchase is necessary to enter.
15. Changes to These Terms
We reserve the right to modify or update these Terms at any time. Changes will be posted on this page, and continued use of the Site constitutes your acceptance of those changes. We recommend reviewing these Terms periodically.
